Many critics of commercial surrogate motherhood argue that it violates the rights of children. In this paper, I respond to several versions of this objection. The most common version claims that surrogacy involves child‐selling. I argue that while proponents of surrogacy have generally failed to provide an adequate response to this objection, it can be overcome. After showing that the two most prominent arguments for the child‐selling objection fail, I explain how the commissioning couple can acquire parental rights by paying (...) the surrogate only for her reproductive labor. My explanation appeals to the idea that parental rights are acquired by those who have claims over the reproductive labor that produces the child, not necessarily by those who actually perform the labor. This account clarifies how commercial surrogacy differs from commercial adoption. In the final section of the paper, I consider and reject three further child‐based objections to commercial surrogacy: that it establishes a market in children's attributes, that it requires courts to stray from the best interests standard in determining custodial rights, and that it requires the surrogate to neglect her parental responsibilities. Since each of these objections fails, children's rights probably do not pose an obstacle to the acceptability of commercial surrogacy arrangements. (shrink)

«Youth policy» as an independent term is defined in the scientific literature in the 1960s., which in many ways «was associated with the formation of youth as an independent social force and its self-determination in the socio-political space». By the 1970s XX century youth policy in the vast majority of developed countries is transforming an independent direction of national policy. Youth is a complex, multidimensional and rather controversial social phenomenon. Modern youth acts as the most active and mobile social group, (...) which requires special attention from state institutions in need of socialization and adaptation. At the same time, it is youth that is increasingly viewed today as the most important and promising part of society. It is no accident that already in the mid-60s of the XX century, in the practical activities of a number of international institutions, in particular the UN, a specialized area of cooperation began to develop, in the field of education and social support for the young generation. It should be noted that in the world there are more than 1 billion 800 million young people under the age of 25, which emphasizes the importance of effective youth policy by members of the international community. In the post-bipolar period, youth policy has become one of the priority areas of state policy of most developed countries. A striking example in this regard is the activities of the countries of the European Union (EU) and its structures. Europe is making significant efforts to create a single space in which not only common political institutions, but common values for all Europeans should be formed. And in this process, it is youth that acts as the key object on which measures are aimed at the formation of a pan-European identity. In recent years, the European Union has significantly stepped up youth policy. Its mechanisms were developed (open coordination method), special institutions were formed. It seems extremely relevant to analyze the EU’s activities in this direction, to consider concrete steps taken at the European level to consolidate measures in the field of youth policy. Despite the fact that integration processes in Europe continue, nevertheless, a number of problems have already been accumulated there today, the success of the entire European project will depend on the solution of these problems. In many ways, these problems are connected precisely with the young generation of Europeans, to whom the EU leadership has special hopes. As noted in a recent communiqué of the European Commission, “social and human capital of youth is one of the greatest European assets of the future». Among the studies affecting various aspects of working with young people, one can single out works of S.V. Aleshchenko, V.P. Baskov, Yu.R. Vyshnevskyi, Yu.V. Volkov, T.I. Zaslavskaia, I.M. Ylynskyi, E.Sh. Kamaldynova, A.I., Kovalova, O.A. Koriakovtseva, V.T. Lysovskyi, V.A. Lukov, O.A. Rozhnov, B.A. Ruchkin, S.K. Savin, V.I. Chuprov and several other authors. However, the young generation of Europeans faces serious challenges. The growth of unemployment, absenteeism, deprivation, the growth of radicalism, cultural indifference (including religious) – main youth problems that today require urgent solutions. Moreover, in different EU countries, these problems have varying degrees of severity. Continued heterogeneity continues to be a serious obstacle to pan-European unity. It is likely that youth policy may be another very painful issue for the future of the EU. Thus, it seems necessary to analyze the national and supranational levels of youth policy in the European Union in order to identify their degree of coherence, common goal-setting and specific implementation methods. B a c k g r o u n d. This article reveals the understanding of the concept of nature in the works of the American philosopher Henry David Thoreau. Henry David Thoreau is an American philosopher, poet, essayist, naturalist and political activist. Together with Ralph Waldo Emerson, his friend and mentor, he is considered one of the founders of the transcendentalist movement. Transcendentalism was a powerful movement of American philosophy of the 19th century. It was characterized by focusing on (...) the problem of human self-knowledge, human's returning to own essence, living in harmony with nature, as well as criticism of modern society and active abolitionism. M e t h o d s. The article uses both general scientific methods and special methods, such as – the method of historical-philosophical reconstruction, which made it possible to reproduce the ideas of the American thinker, the hermeneutic method – for explaining individual positions of the philosopher. In addition, literary-critical methods were used, for the possibility of using various primary sources, and systematic method – to identify a systematized structure in the philosophical work of H. D. Thoreau. R e s u l t s. One of the main features of transcendentalism is a special interest in reflection on nature and a special approach to it. Thus, the concept of nature is present in most of H. D. Thoreau's works, and it is the central topic of his philosophical searches. The concept of nature in his works appears in different contexts, acquires different meanings. Thus, H. D. Thoreau talks about nature in the context of nature, in the context of poetic creativity, in his philosophical searches, in his vision of man and in his argumentation of his own political position. However, the different meanings that H. D. Thoreau attaches to the concept of nature do not contradict each other, but, on the contrary, complement and clarify his understanding of nature. C o n c l u s i o n s. This article proposes to consider the use of the concept of nature by H. D. Thoreau in the following aspects: Nature and Peculiarities of nature as a subject of scientific knowledge. B a c k g r o u n d. The article reveals the connection between the concept of nature of the transcendentalists R.W. Emerson and H.D. Thoreau and the Socio-Political Discourse of the 19th century United States of America. Specific socio-political aspects that formed the basis for the formation of manifestations about nature in the United States in the 19th century were: growing industrialization, the anti-slavery movement, and policies regarding the indigenous population. The article will note the impact of (...) these factors on the formation of the concept of nature. M e t h o d s. The method of historical reconstruction was used to reveal the socio-political context of the philosophy of nature of American transcendentalism. The hermeneutic method was used to interpret the philosophy of nature of R. V. Emerson and G. D. Thoreau, taking into account the socio-political context. A comparative method was used to find common and distinctive features in the philosophical views of American thinkers. The problem-based method made it possible to focus attention precisely on the problems in philosophical views and on the ways of their solution. And the contextual method, the purpose of which is to clarify the context of the appearance and development of a particular idea, this article focuses on the concept of "nature". R e s u l t s. As a result of the study, affinities between the theorization of abolitionism, reflection on industrialization, debate on the indigenous population and the philosophy of nature of American transcendentalism were revealed. C o n c l u s i o n s. The philosophy of the nature of American transcendentalism of R. W. Emerson and H. D. Thoreau is deeply rooted in the socio-political context of the United States of America before the Civil War and became the theoretical foundation of the abolitionist movement. The concept of nature in the philosophy of American transcendentalism is closely related to the socio-political discourse of the United States of America in the 19th century. Radical changes in society before the civil war stimulated the development of both social philosophy and the philosophy of nature. (shrink)

In analogy with Planck’s construction of fundamental quantities in gravitation, we construct fundamental quantities associated with (1) theories of electrodynamics in which the electromagnetic field has a maximum value (e.g. Born-Infeld theory), and (2) the Fermi interaction. This gives us a maximum intensity of the electromagnetic field, and also reveals a close relationship between the fundamental lengths associated with the gravitational and weak interactions, supporting the connection between these two interactions.

Although science supplies medicine's “gold standard,” knowledge exercised in the care of patients is, like moral knowing, a matter of narrative, practical reason. Physicians draw on case narrative to store experience and to apply and qualify the general rules of medical science. Literature aids in this activity by stimulating moral imagination and by requiring its readers to engage in the retrospective construction of a situated, subjective account of events. Narrative truths are provisional, uncertain, derived from narrators whose standpoints are always (...) situated, particular, and uncertain, but open to comparison and reinterpretation. Reading is thus a model for knowing in both morality and clinical medicine. While principles remain essential to bioethics and science must always inform good clinical practice, the tendency to collapse morality into principles and medicine into science impoverishes both practices. Moral knowing is not separable from clinical judgment. While ethics must be open to discussion and interpretation by patients, families, and society, it is nevertheless substantively and epistemologically an inextricable part of a physician's clinical practice. In his letter of December 19, 1860, he commented that this theory "provides a foundation in natural history for our views." An Institute of Medical Ethics working party argues that an ethically desirable relationship of mutual empowerment between patient and clinician is more likely to be achieved if patients understand the ground rules of medical confidentiality. It identifies and illustrates ambiguities in the General Medical Council's guidance on AIDS and confidentiality, and relates this to the practice of different doctors and specialties. Matters might be clarified, it suggests, by identifying moral factors which tend to recur in medical decisions about maintaining or (...) breaching confidentiality. This paper raises the questions: 'What do we expect from nursing ethics?' and 'Is the literature of nursing ethics any different from that of medical ethics?' It is suggested that rather than develop nursing ethics as a separate field writers in nursing ethics should take a lead in making the patient the central focus of health care ethics. The case is made for empirical work in health care ethics and it is suggested that a good way of setting about this (...) is to ask practising nurses about the real ethical problems they encounter. This essay discusses an alternative interpretation of the term “Dasein” as Heidegger uses it in Being and Time and, in particular, the possibility that Dasein is meant to contain an inherent form of intersubjectivity to which we must “return” in order to achieve authenticity. In doing so, I build on the work of John Haugeland and his interpretation of Dasein as a mass term, while exploring the implications such an interpretation has on Heidegger’s conception of “authenticity”. Ultimately, this paper aims (...) to take seriously Heidegger’s claim to be moving past the isolated Cartesian subject and towards a view of authentic human existence that is cognizant of the way our identities are always formed within a pre-existing community. In addition, since many interpretations of Heidegger have argued that “the Anyone” is representative of all possible forms of community, I consider how this alternative understanding of Dasein as intersubjective can shed new light on critical remarks Heidegger makes about “the Anyone”. Thus, I argue that by reinterpreting Dasein as community, we can find more coherence between Heidegger’s otherwise conflicting conceptions of authenticity and “the Anyone”. (shrink)

Ḥaydar al-Harawī (d. 825/after 1427) was a significant scholar from Khorasan who migrated to the Ottoman lands. A distinguished student of al-Taftazanī, he earned high regard from Mehmed I and received patronage from him. al-Harawī dedicated his commentary on al-Zamakhsharī’s al-Kashshāf to Mehmed I with exaggerated expressions of praise and provided significant details about his biography in the introduction of the work. After spending many years in Ottoman lands, al-Harawī established contact with Shahrukh, the son of Timur. He rewrote the (...) introduction of Sharḥ al-Kashshāf and ded- icated the work to Shahrukh. This new patronage relationship is evident in the second version of the introduction, where not only the dedication part but also the content was rearranged concerning the new patron’s identity. Important biographical details not found in the first version are included in the second version, making it a crucial source for al-Harawī’s biography. This article brings the second version of the introduction to light for the first time, constructing al-Harawī’s biography by compiling information from both versions. While no specific dates are provided in either version, the duration of al-Harawi’s stay in certain cities is mentioned. Gaps in the narrative were filled based on histori- cal events, allowing for accurate dating of approximately forty years of al-Harawī’s life, from Sarakhs through Shiraz, Tabriz, Shirvan, Bursa, Edirne, and back to Khorasan. This comprehensive overview sheds light on the relationship between scholars and rulers, the influence of political developments on scholarly life, and the intellectual world of a scholar dedicated to the pursuit of knowledge. For much of human history the idea of a right to life has not seemed self-evident. The credibility of the idea appears to depend on a particular kind of intuition concerning the nature of the world. In this paper, the kind of intuition involved is related to the idea of a covenant, illustrated by that of marriage. The paper concludes by suggesting that talk about responsibilities may be more fruitful than talk about rights.

Ferebee (bio)On August 28, 2021, former Royal Marine and charity worker Pen Farthing was evacuated from Afghanistan with almost two hundred dogs and cats that his Kabul animal charity, Nowzad Dogs, had rescued. The role of the British government in this evacuation remains hotly contested: At the time, the British Ministry (...) of Defence tweeted (Fig. 1) that Farthing's escape had been assisted by the British military, but Farthing later disputed this claim and argued that his rescue was not the result of high-level intervention in the British government. In January 2022 controversy erupted around the emergence of documents suggesting that Prime Minister Boris Johnson had lied to Parliament about the personal role that he played in just such an intervention. Notably, Nowzad's Afghan staff members were not evacuated alongside Farthing and the animals, though they would eventually escape to Pakistan. Following Farthing's escape, the British government failed to evacuate hundreds of British citizens and residents (Merriman and Ghouri), as well as many more Afghans who had worked on behalf of British forces. The Nowzad Dogs evacuation became a site of symbolic struggle over Britain's respect (or lack thereof) for human rights. "What a story to tell the world: Britain values dogs more than Afghan people," the headline of an opinion piece in the Guardian (Hinsliff) read.The story of Nowzad Dogs is interesting to me not only as a tale of human-nonhuman relations, but also because I was, at the time it occurred, volunteering within the Afghan aid community to assist relatives of a friend, British Afghans who had been visiting Kabul when the government [End Page 52] collapsed. The family repeatedly asked for assistance from the British Foreign, Commonwealth and Development Office—assistance that never appeared. Ultimately, due to the generosity of donors and the coordination of a volunteer team, the family was able to flee to Pakistan, where they boarded a commercial flight to London. This case was a particularly stark and powerful illustration of the negotiations of rights and value that took place during and following the evacuation. It seemed nonsensical, in August 2021, to suppose that British citizens, including British children (the family I worked with included a six- and an eleven-year-old who were British citizens), would be abandoned while Afghan dogs had their rights prioritized. As I hope to demonstrate here, however, such an incident becomes comprehensible and even logical when it is understood as part of a specifically Anthropocene manifestation of subjectivity.Upendra Baxi suggests that 1948's Universal Declaration of Human Rights (UDHR) marks a broad shift from the era of "modern" (42) human rights (which began with the American and French Revolutions) to the era of "contemporary" (42) human rights. His periodization links these eras in human rights to shifts in the ideology of capitalism and empire. The "modern" era of human rights, he writes, "signals a whole variety of ideological 'justifications' for colonization and world domination" and "provides a register of major development in industrial capitalism" (42), while the "contemporary" era of human rights "is based on the premise of radical self-determination" (46). Such a periodization also brings human rights into close alignment with the Anthropocene, which is rooted in the capitalist-colonial Enlightenment and Industrial Revolution, yet often dated most concretely to the circa-1950 shift that some (such as J. R. McNeill and Peter Engelke) label the "Great Acceleration." Indeed, one could reasonably appropriate Baxi's terms and speak of "modern" and "contemporary" Anthropocenes mapped identically onto the global timeline.I propose to use the 2021 Afghan evacuation as a site from which to explore how human rights and the Anthropocene have together coproduced certain forms of subjectivity that are essential for the continued smooth functioning of world-ecological capitalism.
